Terms and Condition

Effective Date: July 15, 2026
Last Updated: July 15, 2026

These Terms and Conditions (“Terms”) govern your access to and use of dennismillerselections.com, including any associated pages, forms, product catalogs, communications, purchases, deliveries, and services offered through the website.

The website is owned or operated by Dennis Miller Selections, referred to in these Terms as “Dennis Miller Selections,” “we,” “us,” or “our.”

By accessing the website, submitting information, creating an account, placing an order, or purchasing a product, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the website or place an order.

1. Legal Drinking Age

The website and its alcohol-related products are intended only for individuals who have reached the legal drinking age in their location.

By accessing age-restricted portions of the website, submitting an alcohol-related inquiry, or placing an order, you represent and warrant that:

- You have reached the legal drinking age in the jurisdiction where you reside and where the product will be delivered;

- You are legally permitted to purchase, possess, and receive alcoholic beverages;

- You are purchasing products for personal use and not for unlawful resale;

- The information you provide is complete and accurate; and

- You will not provide alcohol purchased through the website to an underage person.

The legal drinking age is 18 in Alberta, 21 in the United States, and may be 18, 19, 21, or another age in other jurisdictions.

We may use age-gating tools, identity-verification providers, payment information, government-issued identification, or other reasonable methods to verify your age and identity.

A person who has reached the applicable legal drinking age must be present to accept any alcohol delivery. The recipient may be required to show valid government-issued photo identification.

Alcohol will not be delivered to:

- An underage person;

- A person who cannot provide acceptable identification;

- A visibly intoxicated person;

- An unattended address;

- A location where alcohol delivery is prohibited; or

- Any recipient whom the delivery provider reasonably believes cannot lawfully accept the shipment.

Misrepresenting your age or identity may result in order cancellation, account suspension, refusal of delivery, and reporting to appropriate authorities when required.

2. Geographic Availability and Legal Restrictions

Alcohol laws vary between countries, provinces, territories, states, counties, municipalities, and other jurisdictions.

Products displayed on the website are not necessarily available for purchase or delivery in every location.

We reserve the right to:

- Limit the jurisdictions in which products may be purchased or delivered;

- Refuse or cancel an order when shipment or delivery would violate applicable law;

- Restrict particular products, quantities, delivery methods, or destinations;

- Require additional documentation before fulfilling an order; and

- Use licensed importers, distributors, retailers, fulfillment providers, and delivery carriers.

You are responsible for ensuring that your purchase, possession, receipt, transportation, and use of a product are lawful in your jurisdiction.

Nothing on the website constitutes an offer to sell or deliver alcohol where doing so would be prohibited.

3. Licensed Sellers and Fulfillment Partners

Depending on the product and delivery destination, Dennis Miller Selections may operate as a curator, marketing platform, brand representative, importer, distributor, retailer, or facilitator.

A purchase may be accepted and fulfilled by Dennis Miller Selections or by an appropriately licensed third-party retailer, importer, distributor, fulfillment partner, or other seller of record.

The identity of the seller of record may be provided during checkout, on an order confirmation, on an invoice, or through other transaction documentation.

Third-party sellers and fulfillment providers may have additional legally required terms, shipping restrictions, return policies, or verification procedures. When disclosed before purchase, those additional terms form part of your transaction.

4. Website Information Is Not an Offer

Product listings, descriptions, prices, photographs, tasting notes, producer information, vintage information, availability statements, and other website content are invitations to make an offer to purchase and do not constitute binding offers by Dennis Miller Selections.

Submitting an order constitutes your offer to purchase the products listed in the order.

An automated email, text message, payment authorization, or order-number confirmation only confirms that we received your order. It does not necessarily mean that the order has been accepted.

An order is accepted when we or the applicable seller of record expressly confirms acceptance or begins fulfillment, subject to applicable law.

We reserve the right to accept, reject, limit, or cancel an order for reasons including:

- Product unavailability;

- Shipping restrictions;

- Licensing requirements;

- Age-verification failure;

- Suspected fraud or unauthorized payment;

- Incorrect pricing or product information;

- Technical or inventory errors;

- Unusually large quantities;

- Suspected unlawful resale;

- Delivery-address concerns; or

- Legal or regulatory requirements.

If we cancel an order after payment has been collected, we will issue an appropriate refund for the cancelled portion, subject to applicable law.

5. Product Information

We make reasonable efforts to provide accurate product information. However, wines and spirits may vary between vintages, batches, bottlings, markets, and producers.

Product photographs are provided for general reference. Packaging, bottle shape, labels, closures, alcohol content, vintage, size, coloration, and other details may differ from the images shown.

Tasting notes, ratings, serving suggestions, producer stories, and product descriptions are subjective and do not guarantee that a product will meet your individual preferences.

Unless you approve a substitution or the substitution is clearly disclosed before purchase, we will not intentionally substitute a materially different product.

You should review the final product description displayed during checkout or on your invoice before completing a purchase.

6. Product Availability and Quantity Limits

All products are subject to availability.

Small-batch, vintage, allocated, imported, seasonal, and limited-release products may sell out without notice.

We may establish purchase limits per customer, household, payment method, delivery address, geographic area, or transaction.

Adding a product to a shopping cart or submitting an inquiry does not reserve the product.

7. Prices and Currency

Prices may change at any time without prior notice.

The currency applicable to an order will be identified on the website, during checkout, or on the applicable invoice. Prices may be displayed in Canadian dollars, U.S. dollars, or another stated currency.

Unless expressly stated otherwise, displayed prices may exclude:

- Sales tax;

- Goods and Services Tax;

- Harmonized Sales Tax;

- Provincial or state taxes;

- Alcohol-specific taxes;

- Bottle deposits;

- Customs duties;

- Import charges;

- Brokerage fees;

- Shipping charges;

- Delivery fees;

- Adult-signature fees; and

- Other government or carrier charges.

The full amount available to us will be shown before you complete an online payment whenever reasonably practicable.

You are responsible for any taxes, customs charges, duties, exchange-rate charges, or financial-institution fees applicable to your purchase.

8. Pricing and Website Errors

Despite our efforts, pricing, availability, product, shipping, tax, or promotional errors may occur.

We reserve the right to correct an error and cancel an affected order before fulfillment.

When a material error is discovered after you submit an order, we may:

- Cancel the affected item and issue a refund;

- Contact you for approval of the corrected information; or

- Provide another remedy required by applicable law.

We will not charge a higher corrected price without first receiving your approval.

9. Payment

You authorize us and our payment providers to charge the payment method you submit for:

- Product prices;

- Applicable taxes;

- Shipping and delivery charges;

- Adult-signature charges;

- Customs or import charges disclosed at checkout;

- Failed-delivery or redelivery charges when disclosed; and

- Other amounts you approve during checkout.

You represent that:

- You are authorized to use the payment method;

- The billing information is accurate;

- The transaction does not violate any law or agreement; and

- Sufficient funds or credit are available.

Payment authorization does not guarantee order acceptance.

We may use third-party payment processors. Your payment information will also be governed by the payment processor’s terms and privacy practices.

10. Fraud Prevention

We may review orders for suspected fraud, unauthorized transactions, unlawful resale, identity theft, chargeback abuse, or other improper activity.

We may request additional information, including identification, proof of billing address, confirmation from the cardholder, or confirmation of the intended recipient.

We may refuse or cancel an order if the requested information is not provided or if we reasonably suspect improper activity.

11. Shipping and Delivery

Shipping and delivery availability depend on product type, destination, weather, carrier policies, licensing requirements, and applicable alcohol laws.

Estimated shipment and delivery dates are estimates and are not guarantees unless expressly stated otherwise.

Orders may be shipped in multiple packages or by different fulfillment providers.

You are responsible for providing a complete and accurate delivery address, including unit numbers, access instructions, contact details, and any information reasonably necessary to complete delivery.

Alcohol orders generally cannot be:

- Left unattended;

- Delivered without age verification;

- Delivered to a person below legal drinking age;

- Delivered to a post-office box;

- Redirected to a prohibited location; or

- Delivered where alcohol possession or delivery is unlawful.

You must not request that a carrier leave alcohol without obtaining the required signature or age verification.

12. Adult-Signature Delivery

A recipient who has reached the applicable legal drinking age must be available to accept an alcohol shipment.

The delivery provider may require:

- Government-issued photo identification;

- A signature;

- Date-of-birth confirmation;

- Recipient name verification; or

- Other legally required information.

The name on the identification may be required to match the order, although an eligible adult at the delivery address may accept the order where permitted.

Delivery providers may refuse delivery if the recipient:

- Appears to be underage;

- Cannot provide acceptable identification;

- Appears intoxicated;

- Refuses to sign;

- Is not present;

- Requests an unlawful delivery method; or

- Otherwise cannot legally receive the order.

13. Failed Delivery and Returned Shipments

You are responsible for being available to receive your shipment and for monitoring tracking information.

When delivery fails because:

- No eligible adult was present;

- Identification could not be verified;

- The address was incorrect or incomplete;

- The recipient refused the shipment without a legally valid reason;

- The recipient appeared intoxicated;

- The carrier could not safely access the property; or

- The customer requested an unlawful delivery method,

you may be responsible for reasonable redelivery, return-shipping, storage, handling, or restocking costs, where permitted by law.

If a product cannot legally or safely be redelivered, the refund may exclude non-refundable shipping, carrier, handling, or return expenses, except where applicable law requires otherwise.

14. Shipping Delays

Delivery may be delayed because of:

- Weather or temperature conditions;

- Carrier disruptions;

- Customs or border inspections;

- Import or export requirements;

- Inventory shortages;

- Producer delays;

- Labour disputes;

- Natural disasters;

- Government restrictions;

- Licensing requirements;

- Incorrect customer information; or

- Events beyond our reasonable control.

When required by applicable law, we will notify you of a material shipping delay and provide the opportunity to agree to the delay or cancel the affected portion of the order for a refund.

15. Weather Holds

Extreme heat or cold may damage wine and other temperature-sensitive products.

We or our fulfillment providers may delay shipment during unsafe weather conditions to protect product quality.

When a weather hold is applied, we will attempt to notify you and ship the order when conditions are reasonably suitable.

A weather hold does not guarantee that a product will not experience temperature variation during transportation.

16. Inspection of Deliveries

You should inspect your shipment promptly after delivery.

Do not discard the product, packaging, shipping label, cork, closure, or damaged materials until your claim has been resolved.

For damaged, leaking, broken, missing, or incorrect products, contact us as soon as reasonably possible and preferably within 48 hours of delivery.

Include:

- Your order number;

- The affected product;

- A description of the issue;

- Photographs of the bottle and packaging;

- Photographs of any visible shipping damage; and

- Any other information reasonably requested.

Failure to report visible shipping damage promptly may make it more difficult to process a carrier claim, but it does not eliminate any non-waivable legal rights.

17. Cancellations

You may request cancellation before the order enters processing, packing, or shipment.

A cancellation request is not guaranteed.

Once an order has been processed, transferred to a fulfillment provider, imported, packed, or shipped, it may not be cancellable.

To request cancellation, contact us immediately using the contact information below.

Any legally required cancellation rights remain unaffected.

18. Returns, Refunds, and Exchanges

Because alcoholic beverages are regulated products and may be affected by storage, temperature, handling, and chain-of-custody concerns, returns and exchanges may be limited.

Unless required by law, we generally do not accept returns or exchanges because:

- You changed your mind;

- You did not enjoy the taste;

- The product was purchased as a gift;

- You ordered the wrong product;

- You failed to receive the shipment;

- You stored the product improperly; or

- The product’s natural characteristics differed from your personal expectations.

We will review reasonable claims involving:

- Products damaged during shipment;

- Incorrect products;

- Missing products;

- Products that are materially different from their description;

- Orders we cancelled after collecting payment; or

- Products that applicable law requires us to refund or replace.

- Depending on the circumstances and applicable law, the remedy may include:

- Replacement;

- Store credit;

- Partial refund;

- Full refund; or

- Another appropriate remedy.

Refunds will ordinarily be issued to the original payment method.

Nothing in these Terms limits rights or remedies that cannot legally be excluded.

19. Corked or Faulty Wine

Natural sediment, tartrate crystals, label variation, bottle variation, and characteristics associated with a wine’s age are not necessarily defects.

Claims involving cork taint, oxidation, leakage, heat damage, or another suspected product fault will be reviewed individually.

We may request photographs, the original cork or closure, remaining contents, storage information, or return of the bottle where legally and practically permitted.

A refund or replacement is not guaranteed unless required by law.

20. Promotions and Discount Codes

Promotions, coupons, discount codes, and special offers:

- Are subject to their stated expiration dates and restrictions;

- May apply only to eligible products or locations;

- Cannot be combined unless expressly permitted;

- Have no cash value;

- May be limited to one per person or order;

- May exclude shipping, taxes, and fees; and

- May be cancelled or corrected if issued or applied in error.

Promotions cannot be used in connection with unlawful purchases or by underage individuals.

21. Gift Cards

When gift cards are offered, additional gift-card terms may apply.

Gift cards:

- May not be used where alcohol sales are prohibited;

- Do not override age-verification requirements;

- May not be redeemable for cash except where required by law;

- May be subject to fraud-prevention reviews; and

- Cannot be used to purchase alcohol by someone below legal drinking age.

Expiration dates and fees will be governed by applicable law and any terms disclosed when the gift card is purchased.

22. Personal Use and Resale

Unless we approve otherwise in writing, products purchased through the website are sold for personal consumption or lawful gifting.

You must not:

- Purchase products for unlawful resale;

- Export or transport products contrary to law;

- Remove or alter legally required labels;

- Misrepresent the destination or recipient;

- Use multiple accounts to evade quantity limits; or

- Purchase on behalf of an underage or legally prohibited person.

Wholesale, restaurant, retailer, distributor, or other commercial purchases may require a separate written agreement and appropriate licences.

23. Accounts and Passwords

When account functionality is available, you are responsible for:

- Providing accurate information;

- Maintaining the confidentiality of your password;

- Restricting access to your account;

- Updating your information; and

- Notifying us promptly of suspected unauthorized access.

You are responsible for activity conducted through your account unless caused by our failure to use legally required safeguards.

We may suspend or close an account used in violation of these Terms.

24. Electronic Communications

By using the website or providing your email address, you consent to receiving transactional communications electronically, including:

- Order confirmations;

- Payment receipts;

- Shipping updates;

- Delivery notices;

- Account notices;

- Customer-service responses;

- Policy updates; and

- Legally required disclosures.

You are responsible for maintaining a valid email address and reviewing communications relating to your transactions.

Promotional communications are subject to separate consent requirements where required by law.

25. Text Messages

When you expressly consent to receive text messages, we may send customer-service, order, delivery, product-availability, reminder, or promotional messages.

Message frequency may vary. Message and data rates may apply.

Consent to receive promotional text messages is not a condition of purchase.

You may opt out by replying STOP. You may reply HELP for assistance.

Opting out of promotional messages will not prevent essential account, order, security, or customer-service communications where permitted by law.

26. Permitted Website Use

You may use the website only for lawful personal or business purposes consistent with these Terms.

You must not:

- Violate any law or regulation;

- Misrepresent your age, identity, location, or authority;

- Attempt to purchase alcohol illegally;

- Interfere with the website’s security or operation;

- Introduce malware or harmful code;

- Attempt unauthorized access to accounts or systems;

- Scrape or collect website data without permission;

- Use automated tools to place orders or reserve limited products;

- Commit fraud or payment abuse;

- Infringe intellectual-property rights;

- Impersonate another person;

- Submit false, misleading, defamatory, or unlawful content; or

- Use the website in a way that harms Dennis Miller Selections or another person.

27. Intellectual Property

The website and its content, including logos, branding, text, product curation, graphics, photographs, videos, layouts, databases, and website design, are owned by or licensed to Dennis Miller Selections and are protected by applicable intellectual-property laws.

You may view and print reasonable portions of the website for personal, non-commercial use.

You may not reproduce, republish, distribute, modify, sell, license, create derivative works from, or commercially exploit website content without prior written permission.

Third-party brands, producer names, labels, and trademarks remain the property of their respective owners.

28. User Submissions

When you submit a review, photograph, testimonial, comment, message, or other content, you represent that:

- You own or have permission to submit it;

- It is accurate to the best of your knowledge;

- It does not violate another person’s rights;

- It is not unlawful, threatening, defamatory, obscene, or deceptive; and

- It does not contain malicious code.

Unless otherwise agreed, you grant Dennis Miller Selections a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt, and publish the submission for operating and promoting the business.

We will not publicly disclose personal information contained in a private customer-service message except as described in our Privacy Policy or permitted by law.

29. Third-Party Links and Services

The website may link to producers, retailers, social media platforms, payment processors, delivery providers, or other third-party services.

Third-party services are governed by their own terms and privacy policies.

We do not control and are not responsible for the content, security, availability, accuracy, or practices of third-party websites.

A link does not necessarily constitute an endorsement.

30. Responsible Consumption

Alcohol should be consumed responsibly.

You must not use alcohol in a manner that violates the law or creates a risk to yourself or others.

Do not drink and drive. Alcohol should not be consumed by underage individuals or by anyone who should avoid alcohol for medical, pregnancy-related, dependency-related, legal, or other reasons.

Information on the website is provided for general and educational purposes and is not medical or health advice.

31. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis.

We do not guarantee that:

- The website will always be available;

- Website content will be free from errors;

- Product availability will remain unchanged;

- Delivery estimates will always be met;

- The website will be free from viruses or security threats;

- Product descriptions will reflect every bottle variation; or

- A product will meet your subjective preferences.

Any warranties, conditions, or guarantees that cannot legally be excluded remain in effect.

32. Limitation of Liability

To the fullest extent permitted by law, Dennis Miller Selections and its owners, officers, employees, contractors, affiliates, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from:

- Your use or inability to use the website;

- Delivery delays;

- Product availability;

- Third-party services;

- Unauthorized account access not caused by our legal fault;

- Loss of data;

- Lost profits or opportunities; or

- Your unlawful or improper use of a product.

Where liability cannot be fully excluded, our aggregate liability relating to a particular order will not exceed the amount you paid for the product giving rise to the claim, except where applicable law requires a different remedy.

Nothing in these Terms excludes liability for fraud, wilful misconduct, gross negligence, personal injury caused by legally actionable conduct, or another liability that cannot lawfully be excluded or limited.

33. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Dennis Miller Selections and its owners, employees, contractors, and service providers from claims, losses, liabilities, and reasonable expenses arising from:

- Your material violation of these Terms;

- Your unlawful use, resale, export, or distribution of products;

- Your misrepresentation of your age, identity, or authority;

- Your infringement of another person’s rights; or

- Content you submit through the website.

This section does not require you to indemnify us for losses caused by our own legally actionable misconduct.

34. Consumer Rights

These Terms do not waive, restrict, or exclude consumer rights that cannot legally be waived.

If a provision of these Terms conflicts with mandatory consumer-protection law in your jurisdiction, the mandatory law will apply to the extent of the conflict.

Any limitation, exclusion, choice-of-law provision, or remedy in these Terms applies only to the extent permitted by applicable law.

35. Privacy

Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference.

36. Suspension and Termination

We may suspend or terminate website access, accounts, pending orders, or services when we reasonably believe that:

- These Terms have been violated;

- Fraud or unlawful activity may have occurred;

- A person is underage;

- Payment is unauthorized;

- Continued access creates security or legal risk; or

- Suspension is required by a regulator, payment provider, carrier, or government authority.

Termination does not affect obligations or rights that arose before termination.

37. Events Beyond Our Control

We are not responsible for a failure or delay caused by circumstances beyond our reasonable control, including:

- Severe weather;

- Natural disasters;

- Fire or flood;

- Epidemics or public-health emergencies;

- War, terrorism, or civil unrest;

- Government action;

- Customs delays;

- Carrier interruptions;

- Labour disruptions;

- Power or internet outages;

- Supplier shortages;

- Crop or vintage shortages;

- Import restrictions; or

- Changes in alcohol laws.

This section does not remove any refund, notification, or cancellation right required by law.

38. Governing Law

Except where mandatory law requires otherwise, these Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Nothing in this section prevents a consumer from relying on mandatory consumer protections available in the jurisdiction where the consumer resides.

39. Dispute Resolution

Before filing a legal claim, you and Dennis Miller Selections agree to make a reasonable attempt to resolve the dispute informally.

- A written dispute notice should include:

- Your name and contact information;

- The applicable order number;

- A description of the issue;

- The remedy requested; and

- Supporting information.

The parties will attempt in good faith to resolve the matter within 30 days after the notice is received.

If the dispute cannot be resolved informally, it may be submitted to a court with lawful jurisdiction.

Except where mandatory consumer law permits or requires a different location, proceedings relating to these Terms will be brought in Alberta, Canada.

40. Severability

If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will remain in effect.

41. No Waiver

Failure to enforce a provision of these Terms does not waive the right to enforce that provision later.

A waiver is effective only when made in writing by an authorized representative of Dennis Miller Selections.

42. Assignment

You may not assign your rights or obligations under these Terms without our prior written permission.

We may assign these Terms in connection with a merger, acquisition, corporate restructuring, financing, sale of assets, or transfer of the business, subject to applicable law.

43. Entire Agreement

These Terms, the Privacy Policy, the applicable order confirmation, and any additional policies expressly incorporated into the transaction constitute the entire agreement relating to your use of the website and purchase.

A separate written agreement signed by Dennis Miller Selections may override these Terms for a particular commercial or wholesale transaction.

44. Changes to These Terms

We may revise these Terms to reflect changes in:

- Our products and services;

- Website functionality;

- Business practices;

- Service providers;

- Shipping locations; or

- Legal and regulatory requirements.

Updated Terms will be posted on the website with a revised “Last Updated” date.

Changes apply prospectively unless applicable law permits otherwise.

The Terms in effect when an order is placed will generally govern that order.
